The short version.
This site is here to share information about our restaurants and help you find food. Use it for that. Online ordering happens on Toast and is governed by their terms, not ours. Menu items, prices, and hours can change. If you have a serious allergy, please call the restaurant.
Agreement
These Terms of Service (“Terms”) govern your use of thaiginger.com (the “Site”), operated by Thai Ginger Restaurants (“Thai Ginger,” “we,” or “us”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Site.
If you’re using the Site on behalf of a business or organization (catering, events, press), you represent that you have authority to bind that organization to these Terms.
What this Site is for
The Site exists to share information about Thai Ginger restaurants — menu, hours, locations, our story, catering, jobs — and to give you a clear path to order food, sign up for our newsletter, or get in touch.
The Site is intended for users in the United States. If you use it from outside the US, you do so under your own laws and at your own risk.
Online ordering
Online orders are handled by Toast. When you click “Order online” you leave the Site and your order is governed by Toast’s terms, privacy policy, and payment processing rules. We aren’t responsible for outages, errors, or disputes that arise on the Toast platform.
Menu items, prices, hours, and availability shown on the Site are best-effort and may change without notice. The most accurate, real-time information is what appears at the restaurant or in the Toast ordering flow at the moment you place your order.
Allergens and food safety
Allergen information on the Site is provided in good faith based on our recipes and supplier information. We prepare food in kitchens that handle peanuts, tree nuts, soy, wheat, shellfish, eggs, dairy, fish, and sesame — so trace cross-contact is possible even when an item is listed as free of a given allergen.
If you or a guest has a serious food allergy, please call the restaurant before ordering. We’ll do everything we reasonably can to accommodate, but we can’t guarantee an allergen-free environment.
Acceptable use
You agree not to:
- Scrape, crawl, or harvest data from the Site beyond what a normal browser does, or use automated systems to access the Site at volumes that disrupt service.
- Reverse engineer, decompile, or attempt to access the source code or underlying infrastructure of the Site.
- Submit false, misleading, or fraudulent information through any form (contact, catering, jobs, newsletter).
- Use the Site or our forms to send spam, phishing, or any unsolicited communication.
- Interfere with security features, attempt to bypass access controls, or probe the Site for vulnerabilities without written permission.
- Use the Site to violate any applicable law or anyone else’s rights.
- Misrepresent your affiliation with Thai Ginger or imply endorsement we haven’t given.
We may suspend or block access if we reasonably believe you’re violating these rules.
Submissions
When you submit information through a form (contact, catering, jobs, newsletter), you grant us a limited, non-exclusive, royalty-free right to use that submission for the purpose you submitted it — replying to you, quoting your event, reviewing your application, sending you the newsletter you opted into. We don’t use form submissions for advertising. See the Privacy Policy for how we handle and retain that data.
You represent that any content you submit is yours to submit, doesn’t infringe anyone’s rights, and isn’t unlawful, threatening, defamatory, or obscene.
Our content
The text, photography, illustrations, logos, layout, and code on the Site are owned by Thai Ginger or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You may view and share links to public pages on the Site for personal, non-commercial purposes (telling a friend about a dish, posting a link on social media, that kind of thing). You may not copy, reproduce, republish, or repurpose substantial portions of the content — including photos and recipes — without our written permission. The Thai Ginger name and logo are our trademarks; please don’t use them without permission.
Third-party links and services
The Site links to third-party services we rely on or refer to — Toast for ordering, Google for maps, social media profiles, and others noted in the Privacy Policy. Those services have their own terms and privacy practices. We aren’t responsible for them, and a link is not an endorsement.
Disclaimers
We make a real effort to keep the Site accurate and available, but we provide it “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted or error-free.
Information on the Site (including menus, prices, hours, and location details) is provided for general informational purposes and may not be current. For anything time-sensitive or critical — an allergy, a holiday closure, a large catering order — please call the restaurant.
Limitation of liability
To the fullest extent allowed by law, Thai Ginger and its owners, employees, contractors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the Site — including lost profits, lost data, or business interruption — even if we’ve been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to the Site is limited to one hundred U.S. dollars (US $100) or the amount you paid us directly through the Site in the twelve months before the claim, whichever is greater.
Some jurisdictions don’t allow the exclusion or limitation of certain damages, so these limits may not apply in full to you. Nothing in these Terms limits liability that cannot be excluded under applicable law — including liability for fraud or for death or personal injury caused by negligence.
Indemnification
You agree to indemnify and hold Thai Ginger harmless from any third-party claim, loss, or expense (including reasonable attorneys’ fees) that arises out of your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right. We’ll let you know promptly if a claim is made and will cooperate reasonably in the defense.
Governing law and venue
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any dispute that isn’t resolved informally will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction there.
Before filing anything, please email info@thaiginger.com so we can try to work it out. Most things resolve in a phone call.
Changes to these Terms
We may update these Terms occasionally. When we do, we’ll change the “Last updated” date at the top of the page. Material changes will also be noted in a banner on the Site for a reasonable period. If you keep using the Site after a change takes effect, you accept the updated Terms.
Miscellaneous
- Entire agreement. These Terms (with the Privacy Policy) are the entire agreement between you and us about the Site and replace any earlier discussions on that subject.
- Severability. If a court finds any part of these Terms unenforceable, the rest stays in effect.
- No waiver. If we don’t enforce a provision right away, we haven’t given it up.
- Assignment. You can’t assign these Terms without our written permission. We may assign them to a successor (for example, in a sale of the business).
- Headings. Section headings are for convenience only and don’t affect interpretation.
